Family Medical Leave Act (FMLA)

The Family and Medical Leave Act (“FMLA”) is designed to help Associates balance their work and family responsibilities by allowing eligible Associates to take up to 12 weeks of unpaid, job-protected leave in a 12-month rolling calendar period.

An eligible Associate is one who meets both of the following requirements:

  1. Has worked for Fischer Homes for at least 12 months
  2. Has at least 1,250 hours of service for Fischer Homes during the 12 month period immediately preceding the start of leave

FMLA can be taken for any of the reasons listed below:

  • For the birth of a child and to care for the newborn child
  • For the placement, with the Associate, of a child for adoption or foster care
  • To care for an Associates spouse, child, or parent who has a serious health condition; or
  • A serious health condition that makes the Associate unable to perform the essential functions of his or her job
  • For qualifying exigencies related to the foreign deployment of a military member who is the Associate’s spouse, child, or parent is a covered military member on covered active duty.
An eligible Associate who is a covered service member’s spouse, child, parent, or next of kin may also take up to 26 weeks of FMLA leave in a single 12-month period to care for the servicemember with a serious injury or illness.

Under FMLA, Associates have the right to return to an equivalent, but not necessarily the same, position upon returning to work.

While on FMLA leave, the Company will maintain an Associates current benefits for up to 12 weeks. During this time, Associates are responsible for their normal monthly premium payments. Should a leave of absence extend beyond 12 weeks, Associates will receive further communication from the payroll department to set a payment plan for benefit premiums missed while on extended leave.

Leaves Of Absence

Fischer Homes recognizes that there are important moments in life when an Associate needs to be present and away from work. Leaves of absence are available for these moments.

Associates are required to complete and submit a Leave of Absence Request Form prior to their leave to the Payroll and Benefits department.

The Payroll and Benefits department will work directly with the Associate and their supervisor to qualify and administer any approved leave.
